Scattered beer cans key in accident investigation

An accident occurred in Hardin County, Kentucky on June 22 between a Mustang and a truck that resulted in the death of one and the injury of three others. The 17-year-old female driver of the Mustang reportedly died at the scene. Another passenger in the Mustang and the two men in the truck were injured and taken to the University of Louisville Hospital.

Authorities said that the accident occurred when the truck driver, who was driving east on Deckard School Road, slammed into the Mustang traveling north on Patriot Parkway. The force of the accident caused the truck to flip. The female driver and her 18-year-old passenger were extricated from their vehicle. Authorities also reported that the morning after the accident, beers cans were found down the embankment where the accident occurred. Charges may be pending.

Neighbors say that the intersection where the accident occurred is dark at night and has only stop signs to control intersecting traffic. Residents have voiced concern about the intersection, urging officials to install traffic signals and street lights to prevent future accidents.

A case resulting in a fatality may lead to a wrongful death claim, especially if it is proven that the other driver was intoxicated or otherwise negligent. If sobriety tests at the scene or blood-alcohol content tests at the hospital were not performed or administered, a thorough accident reconstruction may be needed to determine liability. A potentially mitigating factor brought against a driver in a case such as this one would be the recognized condition of the intersection which may lead to a claim brought against county officials.
