Kevin Ward's family sues Tony Stewart for wrongful death

Kentucky racing fans may have heard that the family of race car driver Kevin Ward Jr. has filed a wrongful death lawsuit against NASCAR Sprint Cup driver Tony Stewart. The lawsuit, which was filed in Lewis County Supreme Court on Aug. 7, alleges that Stewart showed reckless disregard when his car struck and killed Ward during a race in upstate New York in 2014.

During the Empire Super Sprints race at Canandaigua Motorsports Park on Aug. 9, 2014, Ward left his race car under a caution flag and ran toward Stewart's car. The suit alleges that Stewart purposely revved his 700-horsepower engine as he drove by Ward, which caused the vehicle to slide on the dirt track and slam into Ward, tossing him around 25 feet. The 20-year-old died from massive blunt force trauma approximately 45 minutes later. A New York grand jury declined to charge Stewart over the incident.

Ward's parents issued a statement to the effect that they intended to hold Stewart responsible for his actions. The plaintiffs are seeking unspecified damages for wrongful death, gross negligence, reckless conduct and the suffering Ward experienced from the time he was struck until he died.

Kentucky families who have lost a loved one due to the carelessness of another party or parties may wish to consult with a lawyer. While a wrongful death lawsuit can never replace a loved one, it could bring needed financial relief that helps pay for medical expenses, funeral costs, loss of current and future income, loss of companionship and other damages allowed by statute.
